The Public Service Regulations have been amended to change the process for promotion reviews, and expand the powers of the Merit Protection Commissioner (MPC). The changes commence on 1 April 2025.

These changes are a real positive for CPSU members, with the powers of the MPC significantly expanded, along with the scope of matters that the MPC can review.

Previously, the MPC had a narrow scope of review- essentially it was down to the applicant to prove that they were more meritorious than the successful candidate. These new powers allow the MPC to review the recruitment process, including how it was advertised, whether the steps taken were fair, and how the final decision was made.

Importantly, the MPC has also been granted ‘own-motion’ powers, which allow it to initiate a review at its own initiative.
